(1) Petitioner, William S. Johnson, seeks the issuance of a writ of certiorari to gain review of several claims of error arising from his conviction in the Superior Court on charges of attempted first degree rape, second degree kidnapping, and four counts of sexual assault. Petitioner also requests "declaratory and injunctive relief by the issuance of a judgment by this Court to the effect that Superior Court Criminal Rule 61 is unconstitutional and an order enjoining the defendants from further implementation of this Rule." The State has answered the petition and moved to dismiss.
