On October 30, 1989, petitioner pled guilty to trafficking in phencyclidine and was immediately sentenced to serve a minimum
mandatory sentence of five years imprisonment. On January 31, 1991, petitioner sought to withdraw his guilty plea through
a motion for post-conviction relief pursuant to Superior Court Criminal Rule 61. The Superior Court denied the motion on March
25, 1991 and petitioner did not appeal. On June 27, 1991, the present petition was filed.
